What Is TCPA Compliance?

TCPA compliance means following the Telephone Consumer Protection Act, the U.S. law that sets rules on how businesses call and text consumers. In practice, it comes down to three things: documented consent before you reach out, honored opt-out and do-not-call requests, and records that prove both.

How Does TCPA Compliance Work?

TCPA compliance covers automated calls, prerecorded messages, and text messages sent to consumers, with the strictest rules applying to mobile numbers. Marketing outreach to a cell phone using automated technology generally requires prior express written consent, and that consent has to be specific rather than buried in fine print.

From there, four rules shape day-to-day outreach:

 

  • The number matters, not the account type. TCPA protections attach to the phone number, so a prospect’s mobile is covered even when the conversation is business to business.
  • Consent and do-not-call are separate obligations. Consent is permission to contact someone. A do-not-call request withdraws it, and having consent on file does not override that.
  • Timing is fixed. Calls are limited to 8 a.m. through 9 p.m. in the recipient’s local time zone.
  • Lists need scrubbing. Check against the National Do Not Call Registry and your own internal list, and honor stop requests across every channel rather than only the one someone replied on.

 

Enforcement runs mostly through private lawsuits. Damages are set at $500 per violation, or up to $1,500 if a court finds the violation willful, and several states have passed stricter versions of the law, so one national calling list can trigger overlapping rules.

Why Is TCPA Compliance Important?

TCPA violations are counted per call or text, not per campaign. One unconsented list of a few thousand numbers is a few thousand violations, which is why these cases usually arrive as class actions rather than single complaints.

 

Exposure compounds quietly too. Complaint patterns feed carrier spam filtering, so the outreach creating legal risk is often the same outreach degrading the phone numbers your team depends on.
